Terms of Use

1. Agreement

By creating or using a NorthKind Sound Music account, you agree to these Terms of Use and acknowledge the Privacy Policy. If you do not agree, do not use the account or platform.

2. Accounts

You must provide accurate information, protect your password, and notify NorthKind if you believe your account has been compromised. You are responsible for activity performed through your account. Administrative roles and permissions are assigned only by NorthKind.

3. Member and Artist Profiles

Every account begins as a Member / Music Listener account. Members may select additional descriptions, activate Artist Studio when available, and control eligible public-profile information. Member types describe participation and do not automatically grant administrative access, verification, approval, or public promotion.

4. Content Ownership and Permission

You retain ownership of original content you upload unless a separate written agreement states otherwise. By publishing content on NorthKind, you grant NorthKind a non-exclusive permission to host, display, stream, promote, format, and technically process that content for operation and promotion of the platform. You confirm that you possess the rights and permissions necessary for every uploaded song, recording, lyric, image, name, trademark, document, and other work.

5. Copyright and Prohibited Content

You must not upload content that infringes copyright, privacy, publicity, contractual, or other legal rights. NorthKind may remove or restrict disputed content while a complaint is reviewed. Canadian copyright law may apply to musical, literary, artistic, and other original works.

6. Custom Music Requests

Custom-song requests are subject to separate project details, pricing, approval, production, revision, delivery, and ownership terms presented for that request. Submitting a request does not guarantee acceptance or completion. A request may become restricted from editing after NorthKind begins work.

7. Sales, Prices, and Earnings

Artists may be permitted to set eligible prices within platform limits. Product availability, platform fees, earnings calculations, payment processing, taxes, refunds, and payouts may be governed by additional terms displayed before commerce features are activated. No draft or demonstration price guarantees future availability or payment.

Questions about a charge, cancellation, or refund

Review the product, format, amount, and renewal information shown before submitting payment. If a payment succeeds but access, delivery, or membership status is missing, do not immediately pay again. Contact NorthKind with the order or transaction reference, product title, and approximate date so the transaction can be reviewed. Any cancellation or refund request is assessed according to the transaction status, the product or service supplied, information presented at checkout, applicable law, and any additional terms accepted for that purchase.

8. Acceptable Use

You must not misuse the platform, attempt unauthorized access, interfere with security or streaming limits, scrape protected data, upload malicious files, impersonate another person, harass others, or use NorthKind for unlawful, deceptive, or abusive activity.

9. Availability and Changes

NorthKind is under active development. Features may change, pause, or be removed, and uninterrupted or error-free availability is not guaranteed. Material revisions to these Terms may require renewed acceptance and will be identified by a new version date.

10. Suspension and Termination

NorthKind may restrict, suspend, or terminate accounts or content when reasonably necessary to protect the platform, users, rights holders, or legal obligations. Members may request account closure, subject to lawful retention requirements and unresolved transactions or disputes.

11. Disclaimers and Limitation

The platform is provided on an “as available” basis to the extent permitted by applicable law. NorthKind does not guarantee audience growth, sales, discovery, income, or commercial success. Final warranty exclusions and liability limits require legal review before commercial launch.

12. Privacy

Personal information is handled according to the NorthKind Privacy Policy and applicable privacy requirements. Promotional communications are optional and may be declined or unsubscribed from without preventing ordinary account access.

13. Governing Law

These Terms are intended to be governed by the laws applicable in British Columbia and Canada, subject to mandatory laws that may apply based on the user or transaction. This section requires confirmation by legal counsel.
